TERMS OF PURCHASE

The consumer, as the buyer, concludes a purchase agreement with the sole proprietorship PRIMAS, Tolstojeva 29, 21000 Split, as the seller. For buyers who are legal entities, the Civil Obligations Act and the Electronic Commerce Act apply, and the Consumer Protection Act does not. For legal entities, these General Terms and Conditions apply in the sections that define:

  • prices and payment methods
  • basic product features
  • the ordering procedure
  • delivery methods and costs
  • general information
  • limitation of liability, and
  • the moment the agreement is concluded.

The seller may, at its discretion, grant a legal entity the rights provided to consumers in individual cases. A user is any person who uses the website www.mammamiaart.com, including any buyer or visitor of the website. Purchase agreements concluded through www.mammamiaart.com are governed by law, taking into account in particular the principles and provisions of European Union directives. Contracting through the website www.mammamiaart.com is considered a distance contract. The agreement is concluded at the moment the seller accepts the buyer’s offer, and all content published on the website www.mammamiaart.com constitutes an invitation to make an offer.

The seller may terminate the purchase agreement if the buyer does not pay the purchase price, and is not obliged to deliver the product until the purchase price has been received, except when the buyer chooses cash on delivery. If the buyer, for any reason, does not accept the shipment and it is returned to the seller, the seller will not repeat the delivery.

The General Personal Data Protection Conditions (Privacy Policy) are an integral part of these General Terms and Conditions. Users who do not comply with the General Terms and Conditions and the Privacy Policy must leave and stop using the website www.mammamiaart.com. When a user engages in certain activities on the website, such as creating an account, using the online store, filling in surveys, commenting, publishing content, taking part in competitions or prize draws, or applying for a job, the seller may ask the user to provide additional personal data. In that case, the user is advised to read the Privacy Policy before providing such data.

The content of the website www.mammamiaart.com is available in Croatian and English. The official language for concluding the agreement is Croatian.

MAIN PRODUCT FEATURES

The buyer can learn about the main features of the products on the website www.mammamiaart.com. The seller reserves the right to change information on the website, including product prices, special offers, discounts and promotions, without prior notice. Next to each product image, a description of its main features is provided, together with the price including VAT. Prices, payment conditions and special offers are valid only at the time of the order and/or payment.

ORDERING

Purchases are made on the MAMMAMIA ART website, www.mammamiaart.com, by filling in the order form. When filling in the form, the buyer must enter all required data. A purchase can only be made once the buyer confirms that they have read and understood the General Terms and Conditions and that they are aware that the order implies an obligation to pay. Purchases are possible 24 hours a day, 7 days a week.

The buyer will be notified by e-mail of the order confirmation (receipt of the electronic message containing the buyer’s offer) and of the shipment of the package. If the seller, for any reason, is unable to deliver some of the ordered products, an online store employee will contact the buyer by phone or e-mail to agree on the delivery of a replacement product or, if the buyer prefers, cancellation of the order.

Purchases of products and/or services on behalf of and for the benefit of a minor or a person deprived of legal capacity (fully or partially) may only be made by their legal representatives.

Purchases are made by ordering available products chosen by the buyer based on the product photo and basic information. Photos are for illustration purposes and may not match the available products in every detail. Purchases are made in a few simple steps from the comfort of the buyer’s home, from anywhere in the world. Products are ordered electronically.

By clicking “Add to cart”, the selected product is added to the shopping cart. Adding a product to the cart does not reserve, order or purchase it. The buyer can continue adding products by clicking “Continue shopping”, review the cart by clicking “View cart”, or complete the product selection by clicking “Checkout”.

When the buyer clicks “Checkout”, they are taken to a page where they can choose the payment method and delivery method, enter a coupon or gift card code, add optional notes, and tick the box if they require a tax-deductible invoice (R1). The purchase cannot continue without ticking the box “I accept the general terms and conditions”, by which the buyer confirms that they have read, understood and agree with the General Terms and Conditions, and without ticking the box “I am aware that placing an order implies an obligation to pay”. By clicking “Change cart contents”, the buyer can change the contents of their cart. If the buyer agrees with the purchase of the products in the cart, they can click “Pay”. When the buyer clicks “Pay” and completes the order, the seller will send these General Terms and Conditions to the buyer’s e-mail address, together with an order confirmation and order number confirming that the order has been received and is being processed.

PRODUCT PRICES AND PAYMENT METHODS

The buyer must pay for the ordered product using one of the following methods:

  • Credit or debit card: direct online payment through the card payment service: Visa, Mastercard, Maestro and Diners.
  • Cash on delivery within the Republic of Croatia.

In addition to credit or debit card payments, residents of the Republic of Croatia can use the following additional payment method:

  • Bank transfer: the information required for payment, including the account number to which the order amount must be paid, will be sent to the buyer by e-mail. The buyer can pay via online banking or at a bank branch, post office, FINA, etc. Once payment is received, the ordered products will be sent to the address specified in the order.

DISPUTE RESOLUTION

In the event of a dispute, MAMMAMIA ART and the buyer will try to resolve it amicably. If this is not possible, the Municipal Civil Court in Split shall have jurisdiction, applying Croatian law. Disputes may also be resolved before the Court of Honour of the Croatian Chamber of Economy or other mediation centres.
